24/7 Alcohol Monitoring Under New Washington DUI Law

Posted by Aaron J. Wolff | Jul 24, 2013 | 0 Comments

Last week, Governor Jay Inslee signed into law Washington's new drunk driving law.

A major part of the law is a new alcohol monitoring program that will allow some repeat DUI offenders in certain jurisdictions to avoid jail if they can remain sober, reports King 5 News.

In three counties and two cities, repeat offenders may be allowed to participate in the "24/7" monitoring program. Participants will be required to wear ankle bracelets that can detect alcohol from the individual's sweat. In addition, offenders may have to install a Breathalyzer device in their homes that can detect alcohol on their breath. If offenders test positive for alcohol use, they may be sent to jail.

The 24/7 monitoring program will basically prohibit repeat offenders from drinking alcohol. This would be true whether the offender plans to drive or is simply relaxing at home.

The plan is for the pilot cities and counties to implement the monitoring program to measure its success. If the results are positive, the program may be expanded to more cities and counties throughout Washington. It was not reported which cities and counties would first participate in the program. In addition, it was not reported how eligibility to participate in the program would be determined.

For repeat DUI offenders facing significant jail time, the 24/7 monitoring program may be an attractive alternative that can both keep them out of jail and also impose some forced discipline on their lives.

If you have any questions about the 24/7 monitoring program or other penalties associated with a drunk driving conviction in the Seattle or King County areas, you should talk to an experienced DUI attorney.
