Washington State Trooper Resigns Over Allegations of Sex With DUI Suspect

A Washington state trooper resigned from his position over allegations that he had sex with a DUI suspect, reports the AP.

The state trooper from Yakima, Travis Lamb, was being investigated for having sex with a woman after a drunk driving arrest. Lamb was reportedly performing an investigation of the drunk driving incident. While off-duty, the uniformed Lamb went to the woman's house after she was released from jail. The two then allegedly had sex.

It goes without saying that Lamb is accused of violating the department conduct rules. However, he was not charged with any crimes.

Drunk Driving Investigation

Generally, law enforcement has all the evidence they need for a drunk driving charge after the suspect has either taken or refused a breath or blood test.

Sometimes, police officers are generous in providing a ride home to a DUI suspect.  This case is different as the Trooper had already booked the suspect into jail.  He paid a visit to her home after she was released from jail.  As this was deemed consensual in nature, the Trooper did violate any crime yet his actions warranted him being relieved from serving in law enforcement.

In the decade I have spent both as a prosecutor and DUI lawyer, I have heard of no more than a handful of similar incidences in Washington State. I would venture to guess that most police officers would agree that this conduct is highly irregular and not acceptable.
